General note on data protection

The EU General Data Protection Regulation (DSGVO), the Federal Data Protection Act (BDSG 2018) and, subsequently, the Telecommunications Act and Telemedia Act protect personal data. This is data related to a natural person. Data of legal entities are not subject to this protection.

Personal information is information that can be associated with you. (eg your name, telephone number or e-mail address). Information that is not associated with your identity (such as number of users of the site) is not covered.

Collection and processing of personal data

In connection with your access, data is stored on our servers for backup purposes, which may allow identification:

  • IP address
  • Date
  • Time
  • sided pages
  • updated document
  • HTTP status code

The collection of this data is based on Art. 6 para. 1 lit. f DSGVO. The website operator has a legitimate interest in the technically error-free presentation and optimization of its website – for this purpose, the server log files must be collected.

Additional personal data will only be collected if you voluntarily provide this information, for example in the context of a request or registration.

We only process the personal data provided voluntarily by you. If you share personal information about another person (owner, installer etc), you must obtain their express prior consent beforehand and inform how we process personal information in accordance with our privacy policy.

Explanations of data protection

As a rule, you can access our internet pages without giving any information about yourself. If your name, address or other personal data is needed in individual cases, you will be informed in advance. Your personal usage information will be used to make our service as pleasant and enjoyable as possible. If you decide to provide us with personal information over the Internet, e.g. Correspondence can be handled or an order can be executed, so this data is handled carefully according to the strict regulations of the EU Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG 2018). By accessing the website, we receive usage data that is stored for backup purposes and may allow identification (for example, IP address, date, time, and pages viewed). These data are evaluated by us to get to know the user behavior and to set up statistics. There is no personal utilization. The statistical analysis of anonymous data records remains reserved.

Transfer of personal information to third parties

If data is to be passed on to service providers within the scope of the order data processing, these are bound to the BDSG, other legal regulations and contractually to our data protection declaration. Insofar as we are legally obliged to do so or by court order, your data will be forwarded to the authorized persons to the extent required. For other purposes, we will not share your information with third parties without your express consent.

Security

We store your data on specially protected servers. Access to it is only possible for a few authorized persons who are responsible for the technical, commercial or editorial support of these servers.

Right of withdrawal

If you ask us not to use and / or delete your personal data for further contact, we will do so accordingly. Data which are absolutely necessary for an order processing or for commercial purposes are not affected by a cancellation or deletion. Please understand that in case of cancellation of the personalized service can no longer be provided, since it builds on the use of customer data.

Contact Form:

The collection of personal data in the context of forms serves various purposes arising from the respective form, for example, the processing of inquiries or registration. The option of contacting us via the website contact form is your free choice.

If you write to us via contact form or e-mail, your information from the contact form, including the data you provide there, will be processed for the purpose of processing your request and, if necessary, for the case of follow-up questions.

The specification of an e-mail address, address, city, postal code and country is required to contact us. Under no circumstances will we pass on this data without your consent. Requests from countries with local distributors will be forwarded if it is considered the faster, more efficient processing of the request.

We store inquiries in forms for the management of the website, whereby the entries are evaluated without reference to your person. Storage of this data together with personal data does not take place.

The legal basis for the processing of the data is our legitimate interest in responding to your request in accordance with Art. 6 (1) lit. a GDPR,  Art. 6 (1) lit. f GDPR and, if applicable, Art. 6 (1) lit. b GDPR, if your request is aimed at closing a contract.

Use of cookies

In cookies, text information is collected during an online session and stored in a special file in ASCII format (cookie.txt) on the user’s hard drive. Where the cookie is stored at the user controls the user’s WWW browser. Cookies are information that will be returned to the server on the next online visit. They can only be read by the server that previously stored them. We only use cookies if they are needed for user functions or facilitate the navigation of the websites. The information is not provided to any third party, as cookies are only for the o.g. Purposes are used. Most browsers are set to automatically accept cookies. However, this function can always be deactivated in the browser. You can set your browser to notify you when cookies are sent.

Cookies that are required to carry out the electronic communication process or to provide certain functions you have requested (e.g. shopping cart function) are stored on the basis of Art. 6 (1) lit. f DSGVO. 

Fischer Panda GmbH has a legitimate interest in the storage of cookies for the technically error-free and optimized provision of its services. If other cookies (e.g. cookies for the analysis of your surfing behaviour) are stored, they will be treated separately in this data protection declaration.

Our website uses links from the following companies. These social media links are merely links to the respective providers. As long as these links are not clicked, no transmission to these providers takes place. If you do not want these companies to collect data about you, you should not click on these links.

The data you enter on our social media pages, such as pictures, comments, likes, tweets, videos, etc., are published by the social media platform.

We share your content on our site.  We only reserve the right to delete content such as images and comments if necessary.  The data processing is done in the interest of our public relations and communication.

If you contact us via a social media platform, we will communicate with you via the social media platform.

Our websites may contain links to other websites. We have no influence on the editorial content of external websites and their operators comply with the data protection regulations.

Open source software Matomo 

We use the open source software Matomo to analyze and statistically evaluate the use of the website in accordance with Art. 6 (1) lit. f GDPR. Cookies are used for this purpose (see clause 5). The information generated by the cookie about website usage is transmitted to our servers and summarized in pseudonymous usage profiles. The information is used to evaluate the use of the website and to enable us to design our website in line with requirements. The information is not passed on to third parties.
Under no circumstances will the IP address be associated with other data relating to the user. The IP addresses are anonymized so that an assignment is not possible (IP masking).

IP addresses are stored in Matomo without the last two tuples.

Matomo is only initated if the “cookie_notice_accepted” and “cookie_stats” have been constented by you and these cookies exist. Matomo can be opt outed below. You can also remove the Matomo cookies manually.

Disabling the web analytics will save a “persistent cookie” on your computer if your browser settings allow it. This cookie is intended to signal to Matomo not to collect your browser. Please note that the Matomo deactivation cookie will be deleted if you clean up the cookies stored in your browser. You also need to disable web analytics again if you are using another computer or another web browser.

Right to information, rectification, objection and complaint

Of course, you have the right to request information (Article 15 GDPR) about the data we have stored about you. Likewise, you have the right to rectification (Article 16 GDPR) of incorrect data, blocking and deletion (Article 17 GDPR) or restriction of processing (Article 18 GDPR) and a right to object to the processing of data (Article 21 GDPR). In addition, you have a right of appeal to the responsible data protection supervisory authority.

Revocation of consentThe consent to the processing of the personal data can be revoked at any time with effect for the future. This can be done by notifying us of the address below or by e-mail to info@fischerpanda.de.
